Section 25 of trademark law:

The Trade Marks Act of 1999 allows registered trademarks to be renewed for an additional decade after their registration ends. The owner must apply to the Registrar of Trademarks within a specified time frame and follow the guidelines. If the application is submitted, the registration is extended for another ten years. If the renewal terms are not met within the specified time frame, the trademark can be removed from the register. However, a grace period of six months is allowed for renewals, and if a trademark is delisted due to non-settlement of the renewal charge, the owner can request reinstatement within a year.

Advantages for trademark owners:

  • Continued Protection:ERenewing a trademark ensures exclusive rights to use the mark, preventing confusion and diluting brand distinctiveness.
  • Preservation of Brand Equity:A registered trademark contributes to a business's brand equity and reputation.
  • Prevention of Abandonment:Renewal prevents trademark abandonment, ensuring the trademark remains active and enforceable.
  • Legal Recourse:Renewed trademark registration provides legal recourse against infringers and counterfeiters.
  • Enhanced Market Positioning:Maintaining a registered trademark demonstrates commitment to brand protection, increasing consumer trust and loyalty.
  • Global Recognition:Trademark renewal allows protection in domestic and international markets, supporting business growth and development.
  • Asset Value:A renewed trademark registration adds value to the business and can be licensed, franchised, or sold for profit.
  • Business Continuity:Renewed trademark registrations ensure business continuity and stability, minimizing disruptions caused by potential legal disputes.

Time Limit:

  • Initial Renewal Period:Trademark registrations are typically renewable for an initial period of time after the expiration of the initial registration term. This period may range from several months to a year, depending on the jurisdiction.
  • Grace Period:Some jurisdictions may provide a grace period beyond the expiration date during which a trademark registration can still be renewed, albeit with additional fees or penalties. The duration of the grace period varies but is generally limited to a few months.
  • Late Renewal:In some cases, trademark registrations may be renewed after the expiration of the initial renewal period or grace period, subject to additional requirements and fees. However, late renewal may entail higher fees and may not be available in all jurisdictions.
  • Restoration:In certain circumstances, trademark registrations that have lapsed or been cancelled due to non- renewal may be eligible for restoration. Restoration typically involves demonstrating continued use of the mark or showing exceptional circumstances for the delay in renewal. The time limit for restoration varies and may be subject to specific conditions.
